lllinois judge awards $5.9M to workplace death widow

Workplaces need to be safe for workers to function and for useful work to get done. Several professions that include innate hazards, such as road work and building construction, have to accommodate tough safety standards to reduce the chances of an injury or fatality.

Some dangers cannot be fully eliminated from the workplace, and federal and state agencies that manage occupation safety and health offer both guidelines and laws that get as close as possible. The widow of a 38-year-old electrical worker is the beneficiary of a successful lawsuit for wrongful death after the man was killed in an area administered by the Illinois Department of Transportation. The managing construction company was accused of neglecting caution markers, such as reflective barricades and drums, that could have prevented the fatality.

The worker was a struck by a semi truck traveling through the area. The work contract and specific conditions required caution markers while workers were present on duty in the area. A Cook County judge ruled that the truck driver would have seen the construction area and missed the victim if they had been present.
