A family is planning for visitation and a funeral for an 85 year old woman from Elmhurst after she was struck and succumbed to her injuries on Sunday, May 12, 2013. The woman died as a result of a car accident that occurred on York Street and Van Buren street on May 11 in the afternoon.
The Elmhurst Police Chief says that the accident occurred when a southbound vehicle collided with the vehicle that was driven by the woman. A man who was a passenger in the vehicle and the woman were both transported to a nearby hospital. The man was treated for his wounds and was released. The woman was then transferred to another medical center where she died. The man only suffered minor injuries.
The driver who caused the accident has not been charged with any crime at the time of publication. The DuPage County Accident Reconstruction Task Force is assisting the Elmhurst Police Department. The agencies are continuing an investigation into the matter.
Although no charges have yet been filed in the matter, a person who causes a car accident could end up being a defendant in a civil lawsuit. A victim's family may consider hiring a DuPage County personal injury attorney who could present evidence that the other driver acted in a negligent manner. If the attorney successfully proves all of the elements of a negligence claim, the defendant may be required to provide compensation to the family who has sustained damages. Compensation may be available for medical expenses, burial expenses, funeral expenses and pain and suffering that is sustained due to a family's loss of a loved one.
